On October 20, 2023, a member of the public requested the incident recordings of the Delta Police Department concerning the officer-involved shooting on October 10, 2023, in Delta, Colorado. Prior to this request, the District Attorney’s Office received a similar demand from the legal representative of the person identified as the victim in this incident. Pursuant to C.R.S. 24-31-902(2), we contacted the victim’s legal representative, who determined that the public release of the incident recordings will infringe on a substantial privacy interest of their client that cannot be cured by blurring and or redacting of the victim’s identifying information. Accordingly, we provided the incident recordings directly to the victim’s legal representative and will not release the recording to the public.
