Guilty Verdict Returned for Third Degree Assault

August 15, 2017 — A jury found Defendant Mario Cristoval Gomez guilty of Assault in the Third Degree on August 11, 2017. Assault in the Third Degree is a class one misdemeanor and falls under C.R.S. 18-3-204(1)(a). This was as the result of a two-day trial to jury held before The Honorable Bennet Alden Morris in Montrose County Court. Mario Cristoval Gomez was found not guilty of False Imprisonment, C.R.S. 18-3-303, a class two misdemeanor, and Menacing, C.R.S. 18-3-206, a class three misdemeanor.

A sentencing hearing has been scheduled for October 3, 2017, at 1:30 p.m. before Judge Morris. A pre-sentence investigation report will be prepared by the 7th Judicial District Probation Department.

This Office extends its appreciation to the jurors selected to serve in this case. The time taken from their families, employment, and daily lives is often burdensome. Their attention to the facts presented in this case during the trial is a responsibility that is not always born with ease by our citizens. Our thanks are extended not only to this jury but to all those called to serve as a juror.

The investigative work performed in this case by the Montrose Police Department and its officers should also be acknowledged. Their investigation of this case provided the evidence presented during the trial.
